Rules on the Management of Advertisements for the 26th Summer Universiade

The Rules on the Management of Advertisements for the

26th Summer Universiade have been examined and

adopted at the 59th regular meeting of the 4th municipal

administration of Shenzhen. They are hereby promulgated

and shall take effect as from June 1, 2007.

       Article 1 The present rules are formulated in accordance with the Advertisement Law of the People’s Republic of China in order to strengthen the management of adverstisements for the 26th Summer Universiade at Shenzhen (hereinafter referred to as Shenzhen Universiade).

       Article 2 The Shenzhen Universiade Organizing Committee, advertisement owners, operators and publicizers shall follow the present rules in running the advertisements of Shenzhen Universiade.

       Article 3 The marketing organization of the Organizing Committee, responsible for the operation and management of advertising business for Shenzhen Universiade and as the sponsor of the advertising business, is mandated with the following functions:

1.      Overall operation and management of all the advertising business for Shenzhen Universiade;

2.      Coordination of matters related to Shenzhen Universiade advertising;

3.      Examination and approval of advertising agents;

4.      Examination, supervision and management of all the advertising programs, charges and contracts, as well as the contents, designs, making and setting of advertisements.

Article 4 The marketing organization of the Organizing Committee shall undertake or entrust agents to undertake the following:

1.                 Patent advertisements for the titling, cups, specialized and selected products as well as the name, logo and mascot of Shenzhen Universiade;

2.                 Special advertisements such as the countdown signboard;

3.                 Advertisements at the main venue of the opening and closing ceremonies of Shenzhen Universiade;

4.                 Advertisements at all the competition venues of Shenzhen Univerisiade;

5.                 Advertisements at the offices of various departments of the Organizing Committee, the press center and the residential areas of officials, referees, athletes and journalists;

6.                 Advertisements on printed materials such as news bulletins of the Organizing Committee and various departments, competition schedule handbook, journalists’ manual, hospitality information book, brochures about various venues, notices, commemorative albums, tickets and identity certificates, as well as advertisement on the uniforms of working personnel, vehicles and other related objects;

7.                 Advertisements on TV, radio broadcasts, newspapers and magazines, Internet and outdoor advertising related to Shenzhen Universiade.

Article 5 Those to be engaged in the advertising activities as mentioned in Article 4 of the present rules are subject to examination and verification by the marketing organization of the Organizing Committee and shall sign contracts on advertising management to be submitted to the Organizing Committee for approval.

Article 6 The power of advertising management for Shenzhen Universiade shall be protected by law. No organization or individual person should violate the lawful rights and interests of advertising operators by way of donating products or their sales-promotion.

Article 7 The marketing organization of the Organizing Committee should earnestly protect the rights and interests of advertisement clients and do a good job of the advertising work.

Article 8 Literary, artistic, sport, exhibiting and sales-promotion activities under the name of Shenzhen Universiade are subject to the examination of the marketing organization and the approval of the Organizing Committee.

Article 9 The advertising activities for Shenzhen Universiade should be in compliance with laws, statues and regulations as well as the rules of the Organizing Committee.

Article 10 Video broadcast of Shenzhen Universiade competitions should not be inserted with advertisements unrelated to the Universiade or without the prior permission of the Organizing Committee.

Article 11 Contents which are subject to examination according to law and administrative regulations should not be advertised without prior examination by the industrial and commercial departments.

Article 12 Outdoor advertising for Shenzhen Universiade is subject to approval by the urban administrative department in accordance with the Rules of the Shenzhen Special Economic Zone on the Management of Outdoor Advertisements. Unauthorized outdoor advertising shall be dealt with by the urban administrative law-enforcement department according to law.

Article 13 The industrial and commercial departments shall ascertain criminal responsibility for the following cases of advertising for Shenzhen Universiade:

1.      Law-breaking contents of any advertisement;

2.      Falsified advertisements.

Article 14 The industrial and commercial departments shall deal with in accordance with the rules unauthorized advertising without the approval of the Organizing Committee and in violation of the Rules on Intellectual Property Protection for the 26th Summer Universiade or the Rules on Special Signs Protection for the 26th Summer Universiade.

Article 15 Any one engaged in authorized advertising of Shenzhen Universiade without the approval of the Organizing Committee and causing losses to the advertisement right-holders shall be subject to civil liability accordingly.

Article 16 The present rules shall take effect as from June 1, 2007.
