Participation Confirmation Letter

    The Executive Board of the Shenzhen 26th Summer Universiade ((hereinafter referred to as “the Executive Board”):

    Before taking part in the creation and revision of the works for contest (see Article 11 of the Participation Confirmation Letter for the definition), I have fully understood, comprehended and voluntarily accepted the Design Contest Rules for the Shenzhen 26th Summer Universiade Mascot (hereinafter referred to as the “Rules”) and relevant articles in its attachments, and the following articles:

    1. I create the works for contest in accordance with the requirements of the Executive Board.

    I assure and agree that the intellectual property rights and all relevant rights and benefits (except for the signature right) of the works for contest all belong to the Executive Board.

    2. I fully understand that the intellectual property rights of the works for contest will be transferred once-off, irrevocably, entirely and exclusively to the Executive Board from the day it was submitted to the Contest Office. I have no right for the works for contest, and can not use or develop the works in any way without the prior written approval of the Executive Board.

    3. Since the signing of this letter, I will not propose request and proposition in any form of the intellectual property rights (including but not limited to the copyright, trademark and patent) contained in the works and all the graphic or tridimensional display of the works to the Executive Board or any third party in any occasion, at any time and with any reason.

    4. I commit that the creation and revision of the works for contest do not infringe prior intellectual property rights and other rights of any third party.

    5. I commit that I will not in any form create any form of deductive works based on the design scheme of the works for contest and publish, disclose, copy or release the deductive works in or outside China. The creation, publishing, disclosure, copying and release of the above deductive works and any form of commercial or uncommercial market development or publicity all constitute infringement to the rights of the Executive Board; in such circumstances, I shall undertake breach liabilities regulated in Article 9 of this letter.

    6. I agree that the Executive Board shall pay no expenses for my creation and revision of the works for contest, and I have no right to wherefore demand to enjoy any privileges or share any rights and benefits the Executive Board obtains from relevant activities.

    7. Without the written permission of the Executive Board, I shall not in any form by myself or authorize other party to conduct commercial or uncommercial market development or publicity capitalizing on my participation in the creation and revision experiences of the works for contest stating in this letter at any time and at any place.

    8. The rights of the Executive Board under the works for contest under this letter and my liabilities and commitments under this letter apply to any works similar to the works for contest.

    9. In case that I do not perform relevant liabilities and commitments stated in this letter and do not take effective remedial measures ten days after the delivery of a written notice by the Executive Board requiring amendment in limited time, the Executive Board is entitled to claim wherefore suffered direct or indirect compensation.

    10. Without a prior written approval of the Executive Board, I shall not transfer all or some of the liabilities stated in the articles of this letter.

    11. “The works for contest” refers to the intellectual achievements the participants create in accordance with the requirements of the Rules. In this letter, the relevant regulations of the works for contest and its intellectual property rights apply to all or part of the works for contest, digital forms of the works for contest, any (or all) graphic or tridimensional display forms of the works for contest, and any version or form before, during and after the revision of the works for contest (under the occasion that the works for contest is revised during the creation or after formal submission to the Executive Board).

    12. The Confirmation Letter shall be explained in accordance with the laws of the People’s Republic of China.

    13. The Confirmation Letter takes effect from the day it is signed by the promisee. In case that the applicant do not have full capacity for civil conduct, the guardian of the applicant shall also sign in the signature column, and indicate his/her status as a guardian;
